Terms of Service

1. The agreement

These terms govern your use of GuaranteeCheck, an independent self-help diagnostic tool for homeowners with solar leases or PPAs affected by the Sunnova, SunPower, and PosiGen bankruptcies. By using GuaranteeCheck, you agree to these terms.

2. What GuaranteeCheck is

GuaranteeCheck checks your solar system's actual production against your lease's stated production guarantee, and — if a shortfall is found — drafts a claim letter and evidence packet for you to review, sign, and send to your servicer yourself. It is a calculation and letter-drafting tool, not a legal service, and it does not review the specific legal language of your individual lease.

3. Self-help, not a collections service

GuaranteeCheck is never a party to your claim. It does not contact your servicer on your behalf, does not claim any authority to act for you, and does not take a percentage of any amount you recover. Any claim letter it generates is yours to review and decide whether to send.

4. Pricing and billing

• The diagnostic itself is free — there is no charge to find out whether a shortfall exists.
• A one-time $99 completion fee applies only if a shortfall is found and you choose to generate the claim letter and evidence packet.
• GuaranteeCheck Plus is available at $3.99/month or $29.99/year for unlimited diagnostic re-checks and claim letters with no separate completion fee.
• Current pre-launch state: no real payment processor is connected yet, and no real charge can currently be made through GuaranteeCheck. This section describes the intended pricing model, not a live billing system.

5. Accuracy of your inputs

The diagnostic result depends on the lease terms you enter and the production data you connect or upload. You're responsible for entering your lease's actual terms accurately; GuaranteeCheck doesn't independently verify them against your lease document.

6. Acceptable use

You agree not to:

• Use GuaranteeCheck for any unlawful purpose.
• Submit lease terms or production data you know to be false in order to generate a misleading claim letter.
• Attempt to circumvent the free-diagnostic/paid-completion pricing model through technical means.

7. Disclaimer and limitation of liability

GuaranteeCheck is provided "as is," without warranties of any kind, to the extent permitted by law. It is not legal advice, and whether your specific guarantee is enforceable, whether your specific lease was properly assigned through the applicable bankruptcy proceeding, and whether a servicer will honor a claim are all matters outside GuaranteeCheck's control. We are not liable for indirect, incidental, or consequential damages arising from your use of GuaranteeCheck, including outcomes of any claim you submit to a servicer.

8. Changes to these terms

If we make material changes to these terms, we'll update the date at the top of this page.
